1. Overview

This website, igoskitool.com (the “Site”), is operated under the IGOSKI brand. Throughout the Site, the terms “IGOSKI,” “we,” “us,” and “our” refer to the merchant operating the Site. The Site may allow you to purchase products directly from us or may provide links that direct you to IGOSKI products offered on Amazon or another third-party marketplace.

These Terms of Service (“Terms”) govern your access to and use of the Site and any purchase made directly through the Site. Purchases completed on Amazon or another third-party marketplace are also subject to that marketplace’s terms and policies, as explained in Section 12. By accessing the Site, creating an account, or placing an order directly through the Site, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use the Site.

These Terms do not limit any mandatory rights available to you under applicable consumer-protection law.

2. Eligibility and Accounts

You must be at least the age of majority in your place of residence, or use the Site with the permission and supervision of a parent or legal guardian.

If you create an account, you are responsible for providing accurate and current information, protecting your login credentials, and promptly notifying us of suspected unauthorized use. You are responsible for activity conducted through your account to the extent permitted by applicable law.

3. Products and Product Information

We make reasonable efforts to describe and display our products accurately, including their features, dimensions, compatibility, colors, materials, and intended uses. However, colors and appearance may vary depending on your screen, lighting, and manufacturing tolerances.

Before purchasing, you are responsible for reviewing the product description and confirming that the product is suitable for your intended use. Vehicle, ski, snowboard, tool, equipment, and model references are provided for identification and compatibility purposes unless otherwise stated.

We may change product descriptions, prices, packaging, specifications, or availability when reasonably necessary. Changes will not affect an order that we have already accepted unless required by law or agreed with you.

4. Orders and Acceptance

Submitting an order is an offer to purchase. An automated order-confirmation email acknowledges that we received your order but does not necessarily mean that the order has been accepted. Unless applicable law provides otherwise, we accept an order when we confirm shipment or otherwise begin fulfillment.

We may refuse, limit, or cancel an order for legitimate reasons, including suspected fraud, unauthorized payment, pricing or inventory errors, shipping restrictions, product unavailability, or unusually large quantities suggesting unauthorized resale. If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method.

Please ensure that your billing, shipping, and contact information is complete and accurate. Contact us promptly if you discover an error.

5. Prices, Payments, Taxes, and Duties

Prices may change without notice, but a price change will not affect an order already accepted. The currency, product price, shipping charge, discount, and applicable tax presented at checkout form the amount payable for the order, subject to correction of an obvious error as permitted by law.

You authorize us and our payment providers to charge the payment method you select. Complete payment-card details may be processed by an authorized payment provider and are subject to that provider’s security and privacy practices.

International orders may be subject to import duties, taxes, brokerage fees, or customs charges. Responsibility for these charges will be determined by the delivery terms shown at checkout, our Shipping Policy, and applicable law.

6. Shipping and Delivery

Shipping methods, estimated delivery times, available destinations, and related charges are described at checkout and in our Shipping Policy. Delivery dates are estimates unless we expressly guarantee a date.

We are responsible for the shipment until it is delivered to you or to a person you designate, except where you independently appoint a carrier not offered by us or where applicable law provides otherwise. If tracking shows that a package was delivered but you cannot locate it, contact us promptly using the contact details in Section 23 so that we can review the shipment and assist with a carrier investigation. A carrier’s delivery scan does not automatically waive rights that you have under applicable law.

We are not responsible for delays caused by customs, severe weather, carrier disruptions, incorrect addresses supplied by the customer, or other events outside our reasonable control, but we will provide assistance and any remedy required by applicable law.

7. Cancellations, Returns, and Refunds

If you want to cancel or change an order, contact us as soon as possible. We cannot guarantee cancellation after fulfillment has started. If an order has already shipped, any return will be handled under our Refund Policy.

Eligibility, time limits, return authorization, return shipping, product-condition requirements, exclusions, exchanges, and refund timing are governed by our Refund Policy and applicable law. Nothing in these Terms restricts a statutory right to cancel, withdraw, return defective goods, or receive a legally required remedy.

8. Safe and Proper Product Use

Some IGOSKI products are tools or maintenance products that may involve sharp edges, heated surfaces, wax, chemicals, electricity, or other potential hazards. Read and follow all product instructions, warnings, compatibility information, and equipment-manufacturer guidance before use. Use suitable protective equipment and keep tools and materials away from children when appropriate.

Do not use a product if it appears damaged, incompatible, or unsafe. Contact us if you have questions about its intended use. This section does not exclude responsibility that cannot legally be excluded or limit your rights regarding a defective product.

9. Intellectual Property

The Site and its content—including text, photographs, graphics, videos, logos, product presentations, page designs, and software—are owned by or licensed to IGOSKI and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Site for personal, lawful shopping and informational purposes. You may not reproduce, distribute, modify, publish, sell, scrape, commercially exploit, or create derivative works from Site content without prior written permission, except as permitted by law.

IGOSKI names, logos, and brand elements may not be used in a way that suggests endorsement, affiliation, or authorization without our written permission. References to third-party brands, product names, or models are used for identification or compatibility purposes and remain the property of their respective owners.

  • If you believe content on the Site infringes your intellectual-property rights, contact us using the details in Section 23. Include your contact information, identification of the protected work or right, the relevant Site URL, an explanation of the alleged infringement, and a statement that the information you provide is accurate and submitted in good faith.

10. Prohibited Uses

You may not use the Site or its content:

  • for an unlawful, fraudulent, deceptive, abusive, or unauthorized purpose;
  • to violate another person’s intellectual-property, privacy, publicity, or other legal rights;
  • to upload or transmit malware, viruses, or destructive code;

You grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, adapt, publish, display, translate, and use that User Content in connection with operating, improving, and promoting IGOSKI and its products, subject to applicable privacy and consumer laws.

You represent that you have the rights necessary to submit the User Content and that it is accurate to the best of your knowledge and does not violate any law or third-party right. We may moderate or remove User Content that is unlawful, misleading, abusive, infringing, unrelated, or otherwise violates these Terms. We are not obligated to publish or retain every submission.

We will not knowingly condition a benefit on a positive review. If a review was submitted in connection with an incentive, that relationship should be clearly disclosed as required by law.

12. Third-Party Services and Links

The Site may use or link to services operated by third parties, including payment providers, shipping carriers, social networks, video platforms, analytics providers, Amazon, and other online marketplaces. Third-party services are governed by their own terms and privacy practices.

The Site may include “Buy on Amazon,” “Shop on Amazon,” or similar links that direct you to an IGOSKI product page or storefront on Amazon. When you follow such a link, you leave the Site, and any purchase you complete there is a transaction processed through Amazon rather than a direct Site order. Amazon’s current product information, price, availability, checkout, payment, shipping, cancellation, return, refund, account, privacy, and dispute policies apply to that marketplace transaction. These Terms continue to govern your use of this Site. IGOSKI remains responsible for any obligation that applicable law or an express product warranty places on us, but we do not control Amazon’s website, services, checkout, or policies.

The same principles apply if the Site links to another third-party marketplace. Please review the marketplace’s terms and the order information shown there before completing your purchase.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the Site, you acknowledge that you have reviewed that policy.

14. Errors and Availability

Occasionally, the Site may contain a typographical, technical, pricing, availability, or other error. We may correct errors and update information. If an error materially affects an order you submitted, we will notify you and, where appropriate, offer the choice to confirm the corrected order or receive a cancellation and refund.

We do not guarantee that the Site will always be uninterrupted or error-free. We may maintain, update, suspend, or discontinue part of the Site when reasonably necessary.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and its general informational content are provided on an “as available” basis. We do not guarantee uninterrupted access or that every item of general information will always be complete or current.

This disclaimer does not apply to any express product warranty, statutory warranty, guarantee of conformity, or mandatory consumer right that applies to your purchase. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by law, IGOSKI will not be liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

Where liability may lawfully be limited, our aggregate liability arising from a particular order will not exceed the amount paid for the product giving rise to the claim. This limitation does not apply to fraud, willful misconduct, gross negligence, death or personal injury where liability cannot be limited, legally non-excludable product liability, breach of mandatory consumer rights, or any other liability that applicable law does not permit us to exclude or limit.

17. Indemnification

To the extent permitted by law, you agree to indemnify IGOSKI against third-party claims and reasonable costs arising directly from your unlawful use of the Site, your material breach of these Terms, or your infringement of another person’s rights. This section does not apply to the extent a claim was caused by our own act or omission and does not limit mandatory consumer rights.

18. Events Outside Reasonable Control

Neither party will be responsible for a delay or failure caused by an event outside that party’s reasonable control, except that this section does not excuse payment obligations already due or prevent a consumer from exercising a right or remedy provided by applicable law.

19. Termination

You may stop using the Site at any time. We may restrict or terminate access if we reasonably believe you have materially violated these Terms, used the Site unlawfully, threatened its security, or harmed other users. Provisions that by their nature should survive termination—including intellectual-property, liability, and dispute provisions—will remain effective.

20. Governing Law and Disputes

These Terms and any dispute arising from them are governed by the laws applicable to the merchant, the transaction, and the customer under relevant conflict-of-law and consumer-protection rules. Nothing in these Terms deprives a consumer of mandatory protections or the right to bring a claim before a competent court where such a right cannot lawfully be restricted.

Before starting formal proceedings, please contact us using the details in Section 23 and provide your order number and a description of the issue. We will attempt in good faith to resolve the matter. This informal process does not shorten or waive any statutory limitation period or mandatory right.

21. Severability, Waiver, and Entire Agreement

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver of that provision. These Terms, together with the policies and terms expressly incorporated by reference, form the agreement governing your use of the Site and purchases made directly through it.

We may update these Terms to reflect changes in our operations, products, technology, or legal obligations. The updated version will be posted on this page with a revised “Last updated” date.
